Design Service Terms

Terms for CAS AURUM design concepts, planning work, revisions, approvals, and written agreements.

Scope of Design Services

Design services may include concept direction, visual studies, layout suggestions, material direction, preliminary scope review, estimates, and project planning support selected by the client.

No Licensed Professional Services Unless Written

Unless a signed written agreement expressly says otherwise, design services do not include licensed architecture, engineering, structural design, code compliance, permit filing, general contracting, inspection, construction supervision, or legal advice.

Design Concepts and Recommendations

Design concepts are creative and practical recommendations based on information provided at the time. They do not guarantee final fabrication, installation, engineering approval, product availability, code compliance, permit approval, durability under all conditions, or a specific final appearance.

Client-Provided Information

Clients are responsible for providing accurate photos, plans, dimensions, site details, goals, constraints, budgets, timelines, permissions, HOA or building requirements, and other information needed to evaluate the request.

Accuracy of Measurements

Client-provided measurements may be used for early planning only. Final production, fabrication, installation, procurement, and technical decisions may require site verification, field measurements, professional review, and written approval.

Site Verification

Site conditions, measurements, utilities, wall structure, access, and installation constraints must be verified before fabrication or installation commitments.

Deliverables

Deliverables depend on the selected package and written agreement and may include concept images, notes, preliminary layouts, material direction, or review comments.

Conceptual Images and AI-Assisted Work

Concept images, renderings, collages, AI-assisted visuals, and material studies are illustrative planning tools. They may not show exact dimensions, engineering, code requirements, product availability, grain, veining, color, texture, lighting, hardware, seams, clearances, or site-specific installation details.

Revisions Included in the Selected Package

Only the revisions expressly included in the selected package, proposal, invoice, or written agreement are included.

Additional Revisions and Scope Changes

Additional revisions, rooms, walls, drawings, material research, meetings, technical details, rush work, supplier coordination, trade coordination, or scope changes may require additional fees and schedule changes.

Client Approvals

Client approvals may be required before moving from concept to technical review, procurement, fabrication, shipping, or installation coordination.

Approval Risk

If a client approves a concept, drawing, estimate, material direction, measurement, color, finish, layout, or purchase decision based on incomplete or inaccurate information, the client may be responsible for resulting changes, delays, costs, replacements, or rework.

Fees and Payment

Fees, deposits, payment timing, taxes, and payment methods are governed by the applicable proposal, invoice, checkout page, or written agreement.

No Obligation to Continue Without Payment

CasAurum LLC is not required to start, continue, deliver, revise, procure, reserve, fabricate, ship, coordinate, or release work unless required payments, approvals, and requested information are received and cleared.

Scheduling and Project Timing

Estimated timing depends on client response time, information completeness, material availability, partner scheduling, payment status, and scope complexity.

Material Recommendations

Material recommendations are preliminary unless confirmed in a written project agreement and may change due to availability, suitability, budget, site conditions, or supplier changes.

Product Availability and Substitutions

Products, finishes, hardware, and special-order materials may become unavailable or change. Substitutions require written approval where applicable.

Fabrication and Installation

Fabrication, delivery, installation, and field work are separate from design services unless expressly included in a signed agreement.

Engineering, Permits, and Code Compliance

Design services do not include architectural, engineering, permit, code, or structural services unless expressly stated in a signed written agreement.

Third-Party Contractors and Installers

Third-party contractors, installers, fabricators, carriers, and suppliers are responsible for their own work unless otherwise stated in writing.

Procurement

Procurement may require deposits, supplier terms, lead times, and written approvals. CasAurum LLC is not required to purchase or reserve materials until payment and written authorization are complete.

Shipping and Delivery

Shipping, delivery, storage, access, receiving, damage inspection, and site readiness requirements are governed by the applicable written agreement.

Delays Outside CasAurum LLC's Control

Delays may result from suppliers, carriers, labor availability, site conditions, weather, client approvals, changes, payment delays, or other events outside CasAurum LLC's control.

Intellectual Property in Design Work

CasAurum LLC retains intellectual property rights in unpaid concepts, working methods, templates, design language, and proprietary materials.

Client License to Use Paid Deliverables

After full payment, the client receives a limited, non-exclusive, non-transferable license to use paid deliverables for the specific project for which they were prepared. Unless agreed in writing, deliverables may not be resold, sublicensed, used for another property, used to train models, or used to manufacture competing products.

Unpaid or Draft Work

Unpaid, draft, exploratory, rejected, or preliminary concepts remain CasAurum LLC property and may not be used for fabrication, construction, procurement, publication, or competitive bidding without written permission.

Public Use of Project Images Only With Permission

Submitted and completed project images are not used publicly by CasAurum LLC without separate permission.

Cancellation and Refunds

Cancellation and refund issues are governed by the Refund & Cancellation Policy and the applicable signed proposal, invoice, statement of work, or project agreement.

Limitation of Design-Service Liability

To the fullest extent permitted by law, liability for design services is limited by the applicable written agreement and does not include indirect, consequential, lost-profit, delay, replacement-contractor, loss-of-use, or betterment damages.

Client Duty to Review

Clients are responsible for promptly reviewing deliverables, invoices, schedules, measurements, material notes, drawings, and communications and for raising concerns before approvals, purchases, fabrication, or installation coordination.

Written Project Agreements

These website Design Service Terms do not replace a signed proposal, invoice, statement of work, or project agreement.
